Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Drape mobile application and the Drape Chrome browser extension (collectively, the "App"), operated by Drape LLC ("Drape," "we," "us," or "our"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use Drape. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the App, you represent and warrant that you meet these requirements.

2. Account Registration

• You must create an account to use Drape. We currently support sign-in via Apple, Google, or email and password
• You are responsible for maintaining the security of your account
• You agree to provide accurate information and keep it updated
• You may not create accounts for others or transfer your account
• We reserve the right to suspend or terminate accounts that violate these Terms

3. Subscriptions and Payments

3.1 Subscription Plans

Drape offers subscription plans that provide access to the App's features. Pricing and plan details are displayed in the App at the time of purchase.

3.2 Billing

• Subscriptions are processed by Stripe through our payment partner RevenueCat
• Payment is charged at the time you confirm your purchase via the in-App checkout
• Subscriptions automatically renew at the end of each billing period (monthly) unless canceled before the renewal date
• You can manage or cancel your subscription via the customer portal link in your purchase confirmation email, or by contacting us at the email below
• If we later add billing through the Apple App Store or Google Play, those purchases will be subject to the respective platform's billing terms in addition to these Terms

3.3 Refunds

Refund requests are handled on a case-by-case basis subject to Stripe's standard refund policies. Contact us at the email below to request a refund. Purchases made through Apple App Store or Google Play (if applicable in the future) are subject to the refund policies of those platforms.

4. User Content

4.1 Your Content

You retain ownership of all photos, outfit descriptions, and other content you upload to Drape ("User Content"). By uploading User Content, you grant Drape a non-exclusive, worldwide, royalty-free license to use, display, and process your content solely for the purpose of operating and improving the App.

4.2 Public Content

When you post outfits to the Explore feed or share outfit links, that content becomes visible to other users. You can remove public content at any time by changing its visibility settings or deleting it.

4.3 Content Guidelines

You agree not to upload content that:

• Contains nudity, sexually explicit material, or is obscene
• Depicts or promotes violence, harassment, or hate speech
• Infringes on the intellectual property rights of others
• Contains photos of other people without their consent
• Is fraudulent, misleading, or deceptive
• Violates any applicable law or regulation
• Contains malware, spam, or other harmful content

We reserve the right to remove any content that violates these guidelines and to suspend or terminate accounts of repeat offenders.

5. AI-Generated Content

• Drape uses artificial intelligence to generate virtual try-on images. These are AI-generated composites and may not perfectly represent how garments will look in real life
• AI-generated images are for visualization purposes only and should not be relied upon for purchasing decisions as the sole factor
• Photo quality scores and body measurement estimates are AI-generated approximations and may not be fully accurate
• We do not guarantee the accuracy of any AI-generated content

6. Product Links and Affiliate Disclosure

Drape may contain links to third-party product pages. Some of these links may be affiliate links, meaning Drape may earn a commission if you make a purchase through them. This does not affect the price you pay.

We are not responsible for the products, services, content, or practices of third-party websites. Purchases made through product links are governed by the respective retailer's terms and policies.

7. Intellectual Property

• The Drape name, logo, and App design are the property of Drape LLC
• You may not copy, modify, distribute, or reverse-engineer any part of the App
• Product images scraped from retailer websites remain the property of their respective owners and are used solely for the purpose of virtual try-on visualization

8. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App or its systems
• Use automated means (bots, scrapers) to access the App
• Interfere with or disrupt the App's functionality
• Impersonate another person or misrepresent your identity
• Use the App to create deepfakes or non-consensual imagery of others
• Resell, redistribute, or commercially exploit the App or its content without permission

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure
• AI-generated try-on results will accurately represent real-world appearance
• Body measurements or size recommendations will be accurate
• Product information scraped from third-party websites will be current or accurate

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRAPE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless Drape LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App, your User Content, or your violation of these Terms.

12. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Miami-Dade County, Florida.

You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

Exception: Either party may bring claims in small claims court if the claims qualify.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

14. Termination

• You may stop using the App at any time and request account deletion
• We may suspend or terminate your access to the App at our sole discretion, with or without cause, with or without notice
• Upon termination, your right to use the App ceases immediately
• Sections that by their nature should survive termination (including Disclaimer, Limitation of Liability, Indemnification, and Dispute Resolution) shall survive

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.
